These Legal Terms ("Agreement") apply to all visitors, users, customers, and affiliates ("you," "your") of Elevate by High Ticket Purpose ("Elevate," "Elevate Social," "HTP," "High Ticket Purpose," "we," "us," "our"). By accessing or using our websites, apps, communities, services, software, or affiliate program (collectively, the "Services"), you agree to this Agreement.
Important: If you do not agree to these terms, do not use the Services.

Definitions

| Parent Affiliate | The affiliate under whom an affiliate/customer was referred. |
| Digital Products | Downloadable assets, templates, trainings, libraries, courses, community access, software access, and proprietary content. |
| Genealogy | Network/downline structure associated with an affiliate. |
Eligibility
To use our Services, you must:
- Be at least 18 years old (or the age of majority in your jurisdiction)
- Have the legal authority to enter into this Agreement
- Provide accurate and complete account information
Services Overview
HTP Elevate provides:
- Social media and marketing tools
- Branded dashboards and automations
- DFY/DWY templates, content, and training
- Private community, mentorship calls, and support
- An affiliate program
We may change, improve, or discontinue features without notice if needed for performance, security, or compliance.
Accounts & Security
- You must be 18+ and provide accurate information
- Keep logins confidential; you're responsible for all activity in your account
- Notify [email protected] of suspected unauthorized use
- We may suspend or terminate accounts for security risks or policy breaches
Billing & Subscriptions
Pricing
Prices and features are shown at checkout and may change prospectively. Taxes, VAT/GST, and government charges are your responsibility and may be collected at checkout.
Renewals
Unless canceled, subscriptions auto-renew on the stated cadence.
Failed Payments
We may retry charges; repeated failures may suspend/terminate access and affiliate eligibility.
Trials & Promotions
If applicable, trials convert to paid unless canceled before trial ends. Trial access is limited and may be revoked for abuse.
Strict No-Refunds Policy
All sales are final and non-refundable.
Only exception: An accidental duplicate purchase made the same day (request within 7 days to [email protected]).
Why No Refunds?
- Affiliate commissions are assigned the moment your purchase is completed
- You receive instant access to digital downloads, proprietary trainings, community, and/or systems which cannot be "returned"
Chargebacks
Filing a chargeback without contacting support first is a material breach. We dispute chargebacks using access logs, downloads, timestamps, and IP/device evidence. Breach may result in account termination and forfeiture of unpaid commissions.
Cancellations
- Cancel anytime via your account or [email protected]
- Cancellation stops future billing only; no refunds for past periods
- Cancel ≥72 hours before renewal to avoid the next charge
Acceptable Use & Prohibited Conduct
You agree NOT to:
- Use the Services for unlawful, deceptive, harmful, defamatory, or harassing activity
- Share hate speech, threats, or explicit/obscene content
- Upload malware, attempt to bypass security, scrape, or overload infrastructure
- Misrepresent affiliation with HTP, Elevate Social, HTP Elevate or others
- Reverse engineer, copy, or resell our software/content without permission
- Post pirated content or infringe intellectual property rights
Zero-Tolerance Policy: Harassment, bullying, divisive/defamatory conduct, or repeated negativity may result in immediate removal from our community and/or affiliate program, forfeiture of unpaid commissions, and permanent bans.
Affiliate Program Agreement
Eligibility & Approval
Application, acceptance, and ongoing participation are at HTP's discretion. We may require identity/KYC, tax forms (e.g., W-9/W-8), and compliance review.
Links, Cookies & Attribution
- Use your unique links. Do not cloak/deceive
- We use cookies/IDs for attribution. Cookie windows may vary and are not guaranteed if users clear cookies, switch devices, or use blockers
- Last-click or platform-determined attribution may apply; HTP's tracking and records control in case of conflict
Prohibited Traffic & Claims
- No spam (email/SMS/DM), forced clicks, cookie stuffing, ad hijacking, brand impersonation, misleading countdowns, fake scarcity, or prohibited claims
- No paid ads on our brand keywords or typosquats ("High Ticket Purpose," "HTP," "Elevate Social," etc.) unless we give written permission
- You must follow all FTC/CAN-SPAM/Telemarketing laws and clearly disclose affiliate relationships
- You may NOT promise or imply earnings. Use compliant, general statements with proper disclosures
Commission Structure & Eligibility
Payout Terms
- Schedule, thresholds, and methods are set in your dashboard or affiliate materials and may change prospectively
- Payouts exclude fraudulent/voided/chargebacked transactions
- We may claw back commissions on refunds/chargebacks/fraud
- You are responsible for taxes on your commissions
Commission Eligibility Requirements
To remain eligible for commission payouts, affiliates must:
1. Promote Publicly — Promote HTP on your primary, active platform (the account used at signup or a clearly disclosed replacement). Hidden accounts or private placements are prohibited.
2. Avoid Deceptive Methods — No buried links, private groups, cookie stuffing, or ad hijacking.
3. Post Regularly — Minimum of two (2) posts per calendar month about HTP.
4. Generate Sales — At least one (1) sale or qualifying conversion every 180 days.
5. Maintain Subscription — Keep your required subscription current for the program you're promoting.
Failure to meet these criteria may result in forfeiture of unpaid commissions, suspension, or permanent termination from the affiliate program.
Household & Spouse Rules
To protect program integrity:
One Account Per Household
Unless explicitly approved in writing.
Spouse/Partner Accounts
- Spouses/partners may share one account
- If operating separate accounts, a spouse may purchase HTP but NOT via their partner's affiliate link
- If earning commissions, the spouse must actively promote via their own, separate social media account (not shared/managed by their partner)
No Self-Referrals
Purchases made by you, your spouse/partner, or household under your own referral do not earn commissions.
No Cross-Recruiting Within a Household
Household members cannot enroll in each other's downlines or place orders to trigger commissions.
Violations may result in commission forfeiture, suspension, and/or termination.
Affiliate Transfer Policy
No transfers to a new Parent Affiliate without due process:
- Email [email protected] to request a transfer
- Include a detailed written report with evidence regarding the situation with your current Parent Affiliate
- Review window: approximately 2–3 weeks
- Transfers require company approval
- If approved, you cannot take your team/downline/genealogy — existing team remains with the original structure
Re-Enrollment / Sponsor Changes
If an account is canceled/terminated, re-enrollment under a different sponsor may require a 6–12 month cooling-off period and company approval. We may deny requests at our discretion.
Privacy Policy
HTP Elevate respects your privacy and is committed to protecting your personal information.

- Account Information: Name, email, billing info (processed by third parties), business details, social handles
- Profile Data: Business name, profile photo, bio, links
- Content: Posts, images, videos, support messages, testimonials

- IP address, device/browser, timestamps, pages/features used
- Events (logins, downloads), referral/affiliate IDs
- Approximate location
C. Information from Integrations
If you connect third-party tools (e.g., social accounts, CRMs), we may receive limited data those services share per your settings.
How We Use Data

- Attribute affiliate referrals and calculate commissions
- Personalize content and send account notices
- Prevent fraud/abuse; enforce policies; comply with law
- Analyze usage for performance and product development
How We Share Data
- Service Providers: Hosting, payment processing, email, analytics, fraud prevention
- Affiliates/Partners: Limited, non-sensitive attribution data
- Legal/Compliance: When required by law, to protect rights/safety
- Business Transfers: Merger, acquisition, or asset sale
We do not sell personal information.
Data Retention
- Account & activity records: While active + a reasonable period (typically up to 6 years for tax/audit/legal)
- Logs/analytics: Typically 12–36 months (aggregated or anonymized thereafter)
- You may request deletion; we'll honor subject to legal, security, and accounting obligations
Cookies & Tracking
Types of Cookies We Use:
- Essential: Login/session, security, load balancing
- Functional: Preferences, saved settings
- Analytics: Usage and performance metrics
- Marketing/Affiliate: Attribution, retargeting, campaign performance
Controls
Browser settings, OS-level ad tracking settings, and opt-outs provided by third parties. Disabling certain cookies may impact functionality or affiliate attribution.
Your Rights
GDPR (EEA/UK)
Access, rectify, erase, restrict, portability, object; lodge a complaint with a supervisory authority.
CCPA/CPRA (California)
Know/access, correct, delete, opt-out of "sale/share" (we do not sell), limit use of sensitive info.
How to Exercise Your Rights

International Transfers
We process data in the United States and may use appropriate safeguards (e.g., Standard Contractual Clauses) for cross-border transfers where required.
Children's Privacy
The Services are not for children under 13. We do not knowingly collect data from children; we will delete such data if discovered.
Intellectual Property
All HTP content, software, branding, and materials are owned by us or licensed to us.
Your License
We grant you a limited, non-exclusive, non-transferable license to use content for your own business/educational purposes while your account is active.
Restrictions
You may NOT copy, republish, share, sublicense, or resell our content/templates/training without written consent.
User-Generated Content License
If you submit testimonials, results, or content, you grant HTP a worldwide, royalty-free license to use, reproduce, and promote that content in connection with the Services, with reasonable attribution.
DMCA Notice
If you believe content infringes your copyright, send a notice to [email protected] with: (a) your contact info; (b) description and location (URL) of the material; (c) statement of good-faith belief; (d) statement under penalty of perjury; (e) signature.
Disclaimers
Services "As Is"
We provide the Services "as is" and "as available." To the maximum extent permitted by law, we disclaim warranties (express/implied), including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted, error-free, or virus-free operation.
Earnings Disclaimer
We do not guarantee results or income. Any case studies or examples are illustrative only. Your results depend on your efforts, offer, audience, market conditions, and many variables outside our control.
Third-Party Services
The Services may integrate third-party platforms (e.g., payment processors, CRMs, analytics). We are not responsible for those providers. Your use of them is governed by their terms and privacy policies.
Limitation of Liability
To the maximum extent permitted by law:
- We are NOT liable for indirect, incidental, special, or consequential damages
- Our total liability for any claim is limited to the amount you paid us in the 3 months before the claim arose
- Some jurisdictions do not allow certain limitations; in those, our liability is limited to the fullest extent permitted
Indemnification
You agree to defend, indemnify, and hold HTP harmless from claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your: (a) use of the Services; (b) content or promotions; (c) violation of this Agreement; (d) infringement of third-party rights; or (e) unlawful acts.
Governing Law & Dispute Resolution
Governing Law
Wyoming, USA, without regard to conflicts rules.
Binding Arbitration
Except for small-claims or injunctive relief for IP/confidentiality, disputes will be resolved by binding arbitration conducted in or reasonably near Laramie County, Wyoming (or via remote proceedings) under the rules of a recognized arbitral forum.
No Class Actions
You and HTP waive the right to participate in class, collective, or representative actions and waive jury trial rights.
Time Limit
Any claim must be filed within one (1) year of the event, or it is permanently barred.
Changes to These Terms
We may update these terms. The "Last Updated" date reflects the latest version. Material changes will be communicated via the site/app or email. Continued use after changes = acceptance.
Miscellaneous
- Force Majeure: We are not liable for delays or failures due to events beyond our reasonable control
- Severability: If a clause is unenforceable, the remainder stays in effect
- No Waiver: Failure to enforce is not a waiver
- Assignment: You may not assign this Agreement; we may assign to an affiliate or successor
- Entire Agreement: This is the entire agreement governing your use, superseding prior terms
